Crimes against public health are typified in our Penal Code in articles 359 and following. The trafficking of toxic and narcotic drugs is part of this set of crimes.
It can be considered a traffic offense “Those who carry out acts of cultivation, processing or trafficking, or in any other way promote, favor or facilitate the illegal consumption of toxic drugs, narcotics or psychotropic substances, or possess them for those purposes”. Well then, when the amount confiscated in this type of investigation is of notorious importance, higher penalties may be imposed.
The quantities for it to be considered that it is a crime of notorious importance are regulated in the “Tables of quantities of notorious importance and minimum psychoactive doses of the main toxic substances object of drug trafficking, currently in force”, prepared from international treaties and conventions ratified by Spain.
These amounts vary depending on the type of narcotic we are faced with and the active principle and the necessary dose, since it is calculated taking into account the necessary doses for an addicted person in a certain time.
